ARTICLE 1 – DEFINITIONS
In these Terms & Conditions, the following definitions apply:
Cooling-off period: the period within which the consumer can exercise the right of withdrawal.
Order: a purchase order placed by the consumer for one or more products.
Day: calendar day.
Durable data carrier: any tool that enables the consumer or seller to store information addressed personally to them, in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the consumer’s right to withdraw from a distance contract within the cooling-off period.
Consumer: the natural person not acting in the course of a profession or business who enters into a distance contract with the seller.
Purchase price: the price listed on the website, including VAT.
Model withdrawal form: the form provided by the seller that the consumer may use to exercise the right of withdrawal.
Seller: 93 Selections, part of Cook & Boon Coffeeroasters.
Agreement: the contract formed when the seller accepts the order.
Distance contract: a contract concluded within a system for distance selling, using exclusive remote communication techniques.
Product: a physical coffee product or related item offered for sale by 93 Selections via the website.
Means of distance communication: a method enabling conclusion of a contract without the consumer and seller being physically present simultaneously.

ARTICLE 3 – THE OFFER

If the offer is valid for a limited period or subject to conditions, this will be clearly stated.

The offer is non-binding; the seller may amend or update the offer at any time.

The offer contains a complete and accurate description of the products. Images are intended to be truthful representations, but minor variations may occur. Obvious mistakes or errors do not bind the seller.

Each offer includes clear information regarding:

the price including VAT
-
shipping costs
-
how the agreement is concluded
-
whether the consumer has a right of withdrawal
-
the method of payment, shipping, and execution

The agreement is concluded when the consumer accepts the offer and meets the associated conditions.

If the consumer accepts the offer electronically, the seller will confirm the order as soon as possible by e-mail.

The seller ensures secure transmission of data and a safe online payment environment.

The seller may—within legal boundaries—verify whether the consumer can meet payment obligations.

Upon delivery, the seller provides:

the company’s contact details
-
information on complaints procedures
-
withdrawal instructions, if applicable
-
product-specific information relevant to the agreement

ARTICLE 4 – RIGHT OF WITHDRAWAL
4.1 Exclusion of the right of withdrawal (coffee and consumables)
Products sold by 93 Selections are food items (coffee) and are therefore non-returnable under EU consumer law once shipped, due to perishability and food safety.
The right of withdrawal does not apply to:
-
coffee and all consumable goods
-
products that can perish or deteriorate
-
products whose seal has been broken
4.2 Exceptions
Only unopened, non-perishable products (if ever applicable) may fall under the right of withdrawal. In such cases:
-
The consumer has 14 days after delivery to withdraw.
-
The product must be returned unused, sealed, and in original condition.
-
The consumer must notify the seller via the model form before returning.
If the consumer fails to notify within the cooling-off period or does not return the product in time, withdrawal is no longer possible.
ARTICLE 5 – COSTS IN CASE OF WITHDRAWAL
If (in exceptional cases) a product qualifies for withdrawal:

Return shipping costs are borne by the consumer.

The seller refunds the purchase amount within 14 days of withdrawal confirmation, provided the product is returned in original condition or the consumer supplies valid proof of shipment.
ARTICLE 6 – EXCLUSIONS FROM WITHDRAWAL
The right of withdrawal does not apply to products:
-
created or packaged according to consumer specifications
-
clearly personal in nature
-
which by nature cannot be returned
-
which perish or age rapidly (including all coffee products)
-
whose price depends on market fluctuations beyond the seller’s control
ARTICLE 7 – DELIVERY

Orders are shipped via a carrier selected by the seller.
-
Delivery takes place at the address provided by the consumer.
-
Orders are typically shipped within 14 days unless otherwise agreed.
-
Delivery times are indicative and not legally binding.
-
If a product is unavailable, the seller will offer an alternative or issue a refund.
-
Risk of damage or loss transfers to the consumer at the moment of delivery.
ARTICLE 8 – PRICE AND PAYMENT

All prices listed on the website are in euros, including VAT and excluding shipping.

Prices may be updated; the price at checkout is the final price.
-
Payment must be made via the available payment methods on the website.

Incorrect payment details must be reported immediately.

In case of late payment, the consumer is in default and the seller may charge statutory interest.
ARTICLE 9 – CONFORMITY AND WARRANTY

The seller guarantees that the product complies with the agreement and meets legal requirements.

Defects must be reported within 4 weeks of delivery.
-
Warranty corresponds to the manufacturer’s warranty.
-
Warranty does not apply if:
-
the consumer modifies or repairs the product
-
the product is used incorrectly
-
the product is exposed to abnormal conditions

ARTICLE 10 – COMPLAINTS PROCEDURE

The seller has a clear complaints procedure and handles complaints accordingly.

Complaints must be submitted within 7 days of discovering the issue.

The seller responds within 14 days of receiving the complaint.
-
If a complaint cannot be resolved amicably, a dispute arises.
-
If the complaint is valid, the seller will replace or repair the product free of charge.
ARTICLE 11 – DISPUTES
All agreements between 93 Selections and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
ARTICLE 12 – APPLICABILITY & AMENDMENTS

These Terms & Conditions may be updated by the seller.

The most recent version is always available on the website.

Consumers should review the Terms & Conditions before placing an order.

Upon request, the seller will provide the latest version via email.
